TERMS AND CONDITIONS FOR PARTICIPATION IN AWAKEN YOU ONLINE GROUP COACHING PROGRAM
THIS SERVICE AGREEMENT is entered into on this date between the Client and Susan Mathew of The Refined Mind – for the online program of ‘Awaken You’ (referred to in this agreement as Company).
Service Delivery
Company agrees to provide services of Awaken You program. Customer agrees to abide by all policies and procedures as outlined in this agreement as a condition of their participation in the Program.
The Program shall include:
- Access to the Private Facebook Group and community
- Access to the program’s Online Membership Portal, videos, worksheets and resources
Disclaimer
By participating in this program, you acknowledge that neither the Company nor any third parties warrant that the services will be uninterrupted or error free; nor do they make any warranty as to the timeliness, sequence, accuracy, reliability, completeness, or content of any information or service provided throughout the program.
Client understands that the Company does not offer any warranties, or guarantees, verbally or in writing, regarding your earnings, business profit, marketing performance, audience growth or any results of any kind.
You agree that your results are dependent on various factors including but not limited to, skill, knowledge, ability, dedication, business acumen, and finances and in no way dependent on any information provided by the Company.
Payment Terms
The total price of the Awaken You program is seven hundred Australian dollars AUD700.00) If the payment plan option is elected, the Client will be charged 7 x weekly recurring payments of one hundred dollars – unless expressly agreed otherwise.
The total price of the program for the option of the inclusion of private coaching with Susan Mathew is fifteen hundred dollars (AUD1500.00) If the payment plan option is elected, the Client will be charged 15 x weekly recurring payments of one hundred dollars – unless expressly agreed otherwise.
G.S.T will be applied for Australian residents
If the Client’s payment plan deduction defaults – it is in the discretion of the Company to temporarily suspend access to all Company’s Resources including the Membership Portal, worksheets, videos, resources and Facebook Group – until the payments have been made up to date and in line with the financial agreement.
Protection of Intellectual Property
All materials provided directly or indirectly to the Client throughout any stage of the program are under the strict copyright of the Company.
Client agrees that all materials provided by the Company is solely for their own personal use. Any disclosure, reproduction and sale by the Client to a third party is strictly prohibited.
All intellectual property shall remain solely and exclusively the property of the Company. No license to sell, reproduce or distribute Organizer’s materials is granted or implied. Client agrees not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights of the Company or Participants.
For any violation of the above, the Company will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.
Refund and Cancellation Policy
The Client acknowledges that by committing to this Program, they are committing to fulfil the financial obligations of their participation.
A full 100% Money Back Guarantee is offered within 14 days of commencement of the Program only if the client can substantiate that they are not completely satisfied with the quality of the Program. Client will be required to provide evidence that they have completed the first two modules, their homework, actively participated in the Facebook group and have integrated the teachings genuinely. A Refund will only be provided at the discretion and approval of the Company.
No refund is provided for change of mind.
Client Responsibility
The Program has been developed for strictly educational purposes. Client accepts that they are fully responsible for their progress and results from the Program. The Client understands that because of the nature and extent of the Program, the results experienced by each Client may significantly vary. Client acknowledges that there is no guarantee that they will reach their goals as a result of participation in the Program.
Coaching During Program
You have access to professional coaching during your program. You acknowledge that you are aware that coaching is in no way to be construed as psychological counseling or any type of therapy. Coaching results are not guaranteed. You enter into the coaching and program with the full understanding that you are responsible for your own mental health, and for your results.
Termination
The Company is committed to providing all Clients a positive experience. Client agrees that the Company may, at their sole discretion, terminate, limit or suspend their participation in the Program without refund or forgiveness of monthly payments if the Client becomes disruptive to the Company or Participants, difficult to work with or upon violation of these terms. Client will still be liable to pay the total Program amount.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Tasmania, Australia.
BY PURCHASING THIS PROGRAM, I HAVE READ AND AGREE TO THE ABOVE TERMS AND CONDITIONS.
